State Sen. Rosalind Kurita, who had her 19-vote primary victory overturned by Democratic Party officials last week, has filed a federal lawsuit asking that she be named the party nominee for the seat.Kurita, represented by an Indiana attorney known for representing conservative causes, filed the complaint late Wednesday against every member of the state Democratic Party executive committee, which ruled her Aug. 7 primary victory over Tim Barnes “incurably uncertain.”
County party officials subsequently voted overwhelmingly to name Barnes as the nominee.
The lawsuit argues that the state party violated her due process rights when it invalidated the primary result, and asks that she be put on the general election ballot as the Democratic candidate. The suit also seeks to strike down the state law that governs contested primary results.
